A careless driving ticket with a fine on it gives you three (3) options giving you the option to:

• plead guilty to the charge,
• meet the Prosecutor explain the situation and plead guilty,
• fight the ticket to save your demerit points and insurance rates.

This option is not recommended or advisable:

• a Justice of the Peace listens to the drivers explanation
• the Justice cannot remove any demerit points from the ticket.
• all the Justice is allow to do is lower the fine, they cannot withdraw, dismiss or cancel the ticket.
• the demerit points and conviction go on the driving record for 3 years
• any suspension would apply
• the insurance will be affected.

Never plead guilty or pay a careless driving ticket. Your insurance will go into high risk insurance rates or you may become uninsurable.

This option is not recommended or advisable:

• the court clerk may offer the driver to… “meet the prosecutor, to come to a resolution and avoid going to trial  for Careless Driving“.
• any conviction will affect the insurance
• if the driver meets with the prosecutor, they lose any chance to have the ticket dismissed completely
• any drivers licence suspension will apply

All the prosecutor is allowed to do is reduce the ticket.

Any conviction you accept from the prosecution will on your driving record. You may still lose demerit points and your insurance will be affected for three (3) years.

• it is improper and against the law for a clerk at court to give or offer legal advice.
• clerks are not qualified to give you advice, they have no legal training.
• the clerk is acting in the interest of the court, not the driver.
• the clerks or prosecutors are not obligated to tell you if there is a mistake on the ticket.
• the driver loses any chance to have the ticket dismissed
• the police officer does not have to appear for trial, prosecutor does not have to prove charge in court.

With a careless driving ticket, you must always plead not guilty and set a date for trial.

Setting a trial date to fight your ticket is always the best option for a careless driving ticket because;

• prosecutor has to prove the charge against you.
• while waiting for a trial date, the ticket does not go onto your insurance and demerit points are kept off of your record.
• if the officer or witnesses fail to appear, the charges are usually dropped.
• a trial option gives you the best option to win the case completely.
• many legal issues may occur that result in a win for your case.
