The speeding ticket was dropped at the roadside to speeding 15 over the limit, the fine is only fifty dollars. Why shouldn’t I just pay it and forget about it?
Why Fight a 15km/h over Speeding Ticket
Speeding tickets for 15 over the limit affect insurance rates just like any other traffic ticket.
Although there are no points, once paid the conviction goes on the insurance and driving record for three (3) years, affecting insurance rates each renewal.
Many inexperienced officers may believe if they drop the ticket to no points that you’ll pay it, saving them appearing in traffic court…
About 15km/h over and Insurance
Speeding tickets for 15 over the limit do affect your insurance rates.
Just because the ticket doesn’t have demerit points, doesn’t mean it’s not going to affect your insurance.
The insurance companies care about convictions for traffic tickets not demerit points. Where a driver pays a 15 over speeding ticket the ticket goes on the drivers abstract (drivers licence record) and insurance companies can access that information for three (3) years.
The insurance company sees any convictions for traffic tickets as a risk factor. Where a driver has convictions for speeding regardless of the speed, the conviction goes on the abstract and the insurance company will see it.
Fighting 15 over Speeding Tickets
Experienced police officers do not usually issue fifteen (15) over speeding tickets, it is a sign of a junior police officer or an officer without much experience in traffic court.
As a result many of these tickets are dismissed for one reason or another in traffic court, reasons such as:
- the officer is inexperienced
- the officer made a mistake in the reading
- the officer doesn’t like going to court and hoped by dropping the ticket you’ll pay it
- the prosecutor doesn’t want to proceed on such a minor offence
- the prosecutor believes the officer’s evidence is weak or ill prepared for a trial
As well junior or rookie police officers are sometimes unsure or reluctant to issue speeding tickets and subsequently do not want to appear in traffic court.
Traffic court for many police officers is intimidating. Sometimes officers reduce the speed hoping that the driver will just pay it because there are no demerits and the fine is only a fifty (50) dollars
Inexperienced officers may believe if they drop the ticket to no points that you’ll pay it.
We have heard of officers telling drivers, “there’s no points, it’s just a fine, it won’t affect your insurance”. Nothing could be more misleading and all convictions for traffic tickets can affect your insurance.
